| Method Rationale: | This multi supplier Framework Agreement commenced on the 1st Septemer 2023,and is due to expire on the 31 August 2027. A modification is being proposed for value by 50% of the original Framework value as detailed below. The modification under Reg 72.(1) (c) meets the following conditions: (i)the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; 1) Over the duration of the contract, the EA Cleaning Service have experienced additional pressures on service delvivery that were not forseen at the time of tender, including an unplanned increase in the number of sites requiring service provision. The scale and timing of these additional requirements arose from operational decisions at individual school level and service requests that were not known, planned or capable of being accurately forecast at the time the procurement was undertaken, including but not limited to new build schools, or taking on services in additional schools. 2) This coupled with aging equipment has led to an increased demand on the Framework for new equipment to ensure ongoing service delivery. As a result, demand for floor maintenance machinery has exceeded the levels anticipated when the original Framework value was established. (ii)the modification does not alter the overall nature of the contract; The proposed modification does not alter the overall nature of the Framework. The Framework will continue to be used for the supply of floor maintenance machinery and associated products which fall within the scope of the Framework as originally Awarded. (iii)any increase in price does not exceed 50% of the value of the original contract or framework agreement. The original Framework value was £2,800,000. In accordance with Regulation 72(1)(c)(iii), the maximum permissible increase is therefore 50% of this value, namely £1,400,000. The proposed modification is for £1,400,000, which does not in exceed 50% of the original Framework value. |
