Engaging an alternative supplier would require re‑engineering, recertification or partial replacement of existing racking, resulting in disproportionate cost, delay and risk. On this basis, the Contracting Authority considers that the conditions for a direct award under Section 41 of the Procurement Act 2023, with reference to Schedule 5, 6(b) (only one supplier capable for technical reasons), are satisfied. |
