| Method Rationale: | This Direct Award to a single supplier is justified on the grounds set out under paragraph 7 of Schedule 5 of Procurement Act 2023 where the following conditions are met in relation to the public contract. The following conditions are met in relation to the public contract Paragraph 7 The public contract concerns the supply of goods, services or works by the existing supplier which are intended as an extension to, or partial replacement of, existing goods, services or works in circumstances where- (a) a change in supplier would result in the contracting authority receiving goods, services or works that are different from, or incompatible with, the existing goods, services or works, and (b) the difference or incompatibility would result in disproportionate technical difficulties in operation or maintenance. The Direct Award Contract approach, as outlined within the sector practise, is standard within the sector currently and required to ensure international business is efficient and relationships are maintained in what can be politically complex bi, tri and multi-lateral agreements. CII have the established relationship with the two universities involved in the joint partnership (DUFE and HGU) and also works with another University to support delivery at DUFE. Service disruption could lead to student reallocation, reputational damage, and income loss. CII's continued involvement is critical to safeguarding Ulster's position and growth in China. Therefore, due to the above reasons, a DAC has been chosen as a compliant route to market, as continuity of services is vital. |

To provide suitably qualified and experienced teachers for Ulster University Business School's in-country programmes, cooperate with the Business School to complete high-quality teaching tasks required by domestic partner universities within the Ministry of Education (MoE) approved Joint-Programmes (currently with DUFE and HGU), improve students' learning experience, provide policy guidance and support for Chinese-foreign co-operation in running Joint-Programmes, and to help identify more development opportunities.
