The contract consists of support & maintenance and development services post Go-Live. The current contract between PHE and Northgate expires on the 30th September 2015. PHE has a continuing requirement for the services. A voluntary ex ante transparency notice 2015/S 182-330829 has been published for this requirement. The contracting authority is using the negotiated procedure without prior publication under Regulation 32(2)(b)(ii) and Regulation 32(2) (b)(iii) of the Public Contracts Regulations 2015. In the alternative the contracting authority is relying upon the exemptions from a prior call for competition under Regulation 72(1)(b) as the services cannot for technical and economic reasons be provided by another supplier without causing significant inconvenience to the contracting authority. The National Infant Physical Examination (Newborn Screening Programme) was commissioned by the University of Manchester in 2009 as a managed service with all intellectual property vesting in Northgate (the supplier).
