| Method Rationale: | Regulation 32(5)(b) "the extension of existing supplies or installations where a change of supplier would oblige the contracting authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance" Explanation: UK Parliament has entered into a new lease for office accommodation in Central London. The Landlord has an existing In-Building Cellular solution to support their own mobile communications which is capable of being extended for the accommodation UK Parliament is occupying. The Landlord has supplied the digital Distributed Antenna System 'back-bone' (first-fix) infrastructure throughout the building as part of their CAT A works undertaken by the Landlord contracted to ISG. ExcelRedstone Converged Solutions Limited completed this Distributed Antenna System as a subcontractor to ISG under this contract. The Landlord has a contract with Avison Young as the Building Managing Agent who have also appointed ExcelRedstone Converged Solutions Limited for the maintenance of the existing Distributed Antenna System. The proposed system within Landlord office space is an extension to the landlord system which is a different system to that the Authority usually operates. The Landlord system already has connection to EE, O2 and Vodafone with capacity to support the number of subscribers on the floors occupied by the Authority. Therefore, the proposed scope is an extension of the existing Landlord system as introducing a new system based on the Authority's existing system would mean a further requirement for new base stations from the mobile operators which would result in incompatibility or disproportionate technical difficulties in operation and maintenance together with the associated costs. Accordingly, Regulation 32(5)(b) "the extension of existing supplies or installations where a change of supplier would oblige the contracting authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance" is deemed to apply. In addition, since the above information was published in a VEAT notice, the requirement has extended to include the associated electrical and builders works as well as out of hours working. |
