To build resilience, we require two flexible contracts. This is largely to mitigate against suitable resources not being available or in case there are any actual or potential conflicts of interest that cannot be resolved.
The objective of this tender process is to ensure that Ofwat has in place provision for the expertise and technical support needed in order to fulfil its statutory functions in respect of deciding trade effluent appeals. This will most likely take the form of the Supplier producing written reports which may include:
- technical grounds and justification for trade effluent consent conditions in dispute;
- recommendations as to whether trade effluent consent conditions are reasonable; and
- if appropriate, recommended new trade effluent consent conditions.
Any timescales for deliverables will be case specific. We will typically require a report to be provided first followed by any potential review of draft decision responses.
The Customer may also require ad-hoc written and telephone advice on an informal basis on individual appeals.
Further, any trade effluent appeal is considered OFFICIAL: SENSITIVE and, as such, discretion must be applied.
The flexible ad hoc Services contract will be for 3 years from the date the contract commences.

Please note that there is a potential of the occupied space to be reduced by circa 2,000 sq. ft. at some point during the Term of the contract. If this is the case, then it is expected that the cost of the Services will also be reduced to reflect this reduction. Ofwat will keep the Supplier informed as soon as it is able to. We also invited the Civil Service Commissioner (CSC) to speak to our People Leaders about the importance of the Civil Service Recruitment Principles. As an arms-length Civil Service body, we are subject to a legal requirement to uphold the Civil Service Commission Recruitment principles and standards. These principles require that appointment is on merit on the basis of fair and open competition and set out various requirements in order to meet this standard (including the way that we advertise and promote our roles). All Civil Service bodies are audited by the CSC against this standard, with results published openly in their annual report. In the most recent Audit, Ofwat was rated as Poor, Static. Many of our improvement activities are focused on improving this rating in future audits.
We have also created two Graduate campaigns in 2021 and 2022, employing in total 20 graduates. Here, we worked with an external partner to create adverts, dedicated webpage, videos, open evening and social media presence.
We have produced our Gender Pay Gap report and an Ethnicity Pay Report.

? Control who speaks at each open challenge session.
? Make sure that the water company responds to questions.
? Aim to make sure all types of attendees are comfortable in the meeting and are
given opportunities to pose questions to the water company.
? Avoid the open challenge session focussing on dominant voices, or on a single
issue.
? Make sure that all attendees of an open challenge session comply with a code
of conduct for the meeting, ensuring that all attendees are treated fairly,
sensitively and with respect.
? Review and sign off a written record of the discussion at each open challenge
session, within an agreed timeframe after each meeting. The initial draft of the
record of the discussion will be created by companies for the Independent
Chair(s)/Ofwat/CCW's review.
The Independent Chair(s) will be supported by a joint Ofwat and CCW team, who will:
? Provide briefings ahead of each block of open challenge sessions, with input
from companies where appropriate.
? Provide background information on each of the water companies, including
briefings from individual water companies, where necessary.
? Agree 'choreography' of spoken and technical contributions to each meeting.
? Attend each meeting as observers and note takers and provide a reference
point for the Independent Chair.
